On January 14, 2016, USCIS informed us that local USCIS field offices “have been reminded to allow applicants to retain their Employment Authorization Documents (EADs) at the conclusion of an interview for adjustment of status.” USCIS also updated the official October 22, 2015, AILA liaison meeting minutes to reflect this change in policy. Should a USCIS officer request an applicant’s EAD card at the conclusion of a successful adjustment of status interview, we cite to this guidance and request that the client not be required to relinquish his or her non-expired EAD.
It is important to note that once the “green card” has been issued, normally 3 day to 3 weeks later, the client no longer needs the EAD.
