BIA Says Noncitizen Who Gives False Testimony Before an IJ to Obtain Benefits Can’t Establish Good Moral Character
In a precedent decision issued on June 27, 2016, the BIA held that a noncitizen cannot establish good moral character under INA §101(f)(6) if, during the period for which it is required, he or she gives false testimony under oath in proceedings before an IJ with the subjective intent of obtaining immigration benefits.
