The U.S. Supreme Court granted the Obama administration’s petition for a writ of certiorari. In addition to the questions presented by the petition, the Court directed the parties to brief and argue the following question: “Whether the Guidance violates the Take Care Clause of the Constitution, Art. II, §3.” This means that the Supreme Court will hear arguments from both sides and decide if extended DACA and DAPA are lawful.
